If your home is in foreclosure, you are far from alone.<\/p>\n<p>Fortunately, California law provides important protections for homeowners to challenge <a title=\"wrongful foreclosures\" href=\"https:\/\/voklaw.com\/foreclosure-defense\/\">wrongful foreclosures<\/a> and potentially stop the process.<\/p>\n<p>Below, we explain how the foreclosure process works in California\u2014specifically the Notice of Default (NOD) and the Notice of Trustee\u2019s Sale (NOTS)\u2014and what you can do to protect your home.<\/p>\n<h2><strong>Notice of Default (NOD)<\/strong><\/h2>\n<p>The NOD is the first formal step in <a title=\"California\u2019s non-judicial foreclosure process\" href=\"https:\/\/dcba.lacounty.gov\/portfolio\/foreclosure\/\" target=\"_blank\" rel=\"noopener\">California\u2019s non-judicial foreclosure process<\/a>, governed by <a title=\"California Civil Code \u00a7 2924\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=2924.&amp;lawCode=CIV\" target=\"_blank\" rel=\"noopener\"><strong>California Civil Code \u00a7 2924<\/strong><\/a>. When a borrower falls behind on their mortgage payments, the lender\u2014or more commonly, the trustee\u2014records the NOD at the county recorder\u2019s office in the county where the property is located.<\/p>\n<h2><strong>Key Requirements of the NOD:<\/strong><\/h2>\n<p>\u2022 It must be recorded and mailed to the borrower, any junior lienholders, and others entitled to notice within 10 business days of recording.<br \/>\n\u2022 It must specify the nature of the default, the amount of payments in arrears (plus late fees and other charges), and provide contact information for the lender or servicer.<br \/>\n\u2022 It must include a declaration of compliance with the Homeowner Bill of Rights if the property is an owner-occupied residence, confirming that the lender contacted the borrower (or attempted contact) to explore foreclosure alternatives.<\/p>\n<p>After the NOD is recorded, the borrower has at least 90 days to cure the default by paying the amount specified in the notice. This is called the \u201creinstatement period.\u201d If the borrower pays the amount due, the foreclosure process stops.<\/p>\n<h2><strong>Notice of Trustee\u2019s Sale (NOTS)<\/strong><\/h2>\n<p>If the borrower does not cure the default within the 90-day reinstatement period, the trustee may proceed by recording a NOTS. This step is also governed by <strong>California Civil Code \u00a7 2924f<\/strong>.<\/p>\n<h2><strong>Key Requirements of the NOTS:<\/strong><\/h2>\n<p>\u2022 It must be recorded, posted on the property, and mailed to the borrower and other interested parties at least 20 days before the scheduled auction date.<br \/>\n\u2022 It must specify the date, time, and location of the foreclosure sale, as well as the trustee\u2019s contact information and a statement that the property will be sold at public auction to the highest bidder.<br \/>\n\u2022 It must include language explaining the borrower\u2019s right to reinstate the loan up to five business days before the sale date (the \u201cright of reinstatement\u201d under <a title=\"Civil Code \u00a7 2924c\" href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=2924c.&amp;lawCode=CIV\" target=\"_blank\" rel=\"noopener\">Civil Code \u00a7 2924c<\/a>).<\/p>\n<h2><strong>The Auction Process<\/strong><\/h2>\n<p>If the borrower does not reinstate or pay off the loan, the trustee\u2019s sale proceeds at public auction.
